These Terms of Service ("Terms") govern your access to and use of browzey.ai and its related pages, applications, and services (collectively, the "Service").
At this time, the Service is operated under the browzey.ai brand ("Browzey", "we", "us", "our"). A legal entity may be formed later; if so, references to Browzey include that entity.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Browzey provides tools and services that may include various features and utilities ("Features"). Features may change over time.
You are responsible for reviewing and verifying any content you create or generate using the Service before using or publishing it.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you use the Service on behalf of an entity, you represent you have authority to bind that entity.
3. Account Registration and Security
Certain Features require an account. You agree to provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account.
4. Credits, Plans, Billing, and Taxes
4.1 Credits and Monthly Reset
The Service may use credits to access certain Features. Browzey may provide free credits as part of a plan or promotion.
Credit balances reset on the first day of each month (UTC). Unused credits (free or paid) do not roll over and expire at the monthly reset, unless the Service explicitly states otherwise.
Browzey may change credit rules and plan limits from time to time. Changes apply prospectively.
4.2 Purchases and Billing
If you purchase credits or a subscription, you authorize Browzey (or its payment processor) to charge your selected payment method for the applicable fees and taxes.
4.3 No Refunds
All purchases are final and non-refundable, except where required by applicable law.
4.4 Taxes
Fees may be exclusive of applicable taxes. You are responsible for taxes, duties, or charges imposed by your jurisdiction, except taxes based on Browzey's income.
5. Third-Party Services
The Service may integrate with third-party services. Your use of third-party services is governed by their respective terms and policies. Browzey is not responsible for third-party services, including account restrictions, API changes, outages, or policy enforcement by third parties.
6. User Content and License
6.1 User Content
"User Content" includes anything you submit to the Service, including text, content, drafts, edits, and settings.
You represent that you own or have the necessary rights to submit User Content and that it does not violate law or third-party rights.
6.2 License
You grant Browzey a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, and display your User Content solely to:
- operate and provide the Service,
- maintain, secure, and improve the Service,
- comply with legal obligations.
Browzey does not claim ownership of your User Content.
6.3 Feedback
If you provide feedback or suggestions, you grant Browzey the right to use them without restriction or compensation.
7. AI-Generated Output
The Service may generate text or other outputs ("Output"). Output may be inaccurate, incomplete, or unsuitable. You are responsible for verifying accuracy, legality, originality, and suitability before use or publication. Browzey does not guarantee results, engagement, or platform compliance.
8. Acceptable Use
You agree not to misuse the Service. You must not:
- violate any law or third-party terms,
- generate or facilitate spam, scams, phishing, or deceptive content,
- impersonate others or misrepresent affiliation,
- harass, threaten, defame, or promote hate or violence,
- upload malware or attempt to disrupt the Service,
- scrape, reverse engineer, or attempt to extract source code (except where prohibited by law),
- bypass rate limits or access controls.
Browzey may suspend or terminate accounts for violations.
9. Intellectual Property
Browzey owns all rights in the Service, including software, UI, branding, and documentation, except for User Content. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal or business purposes, subject to these Terms.
You may not copy, resell, sublicense, or commercially exploit the Service except as explicitly permitted by Browzey in writing.
10. Privacy
Browzey's collection and use of personal data is described in the Privacy Policy.
11. Termination
You may stop using the Service at any time. Browzey may suspend or terminate your access immediately if you violate these Terms, if required by law, or to protect the Service, users, or third parties.
Upon termination, your access ends and any remaining credits may be forfeited, except where required by applicable law.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROWZEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Browzey does not warrant the Service will be uninterrupted, secure, error-free, or that Output will be accurate or meet your needs.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROWZEY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROWZEY'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO BROWZEY IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR CHF 100 IF YOU PAID NOTHING), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.
14. Indemnification
You agree to indemnify and hold harmless Browzey and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:
- your use of the Service,
- your User Content,
- your violation of these Terms or any law,
- your violation of any third-party rights.
15. Changes to the Service and Terms
Browzey may modify the Service or these Terms from time to time. Updated Terms will be posted with a new effective date. Continued use after changes become effective means you accept the updated Terms.
16. Governing Law and Venue
These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules.
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Bern, Switzerland, unless mandatory law provides otherwise.
